The defendant, Jesse Lynn, was indicted in the circuit court of Logan county for manslaughter. The indictment consisted of six counts. An order of nolle prosequi was entered as to the first count. Motions to quash were sustained as to the third and fourth counts, but overruled as to the second, fifth and sixth. There were two jury trials. Upon the first, the jury disagreed. The second trial resulted in a verdict of guilty under the second count.
