Defendant appeals from an order denying his motion for a new trial.

Defendant, a former treasurer of Todd county, by an information filed on March 19, 1951, was charged with committing the crime (M. S. A. 620.01 [4] and Minn. Const, art. 9, § 12) of receiving $11,689.42 for the county as a public officer thereof and wilfully omitting and refusing to pay over the same to his successor when the defendant left office on Jume 6, 1950.
