On exceptions. This case is before the. court on exceptions to the acceptance of a referee’s report in favor of the plaintiff. The case was heard by a referee under a rule of court with right of exceptions reserved as to matters of law. By agreement of the parties the case was set by the referee for a hearing on February 28, 1951. On that date, at the request of defendant’s counsel, it was continued to the 7th of March.
