The complaint in this case,which was originally commenced before a justice of the peace of Crawford county, is in the usual form of declarations in actions upon the case for negligence, and alleges, substantially, that the defendants, by their agents and servants, with their engines and train of cars, propelled by steam, while running oiler their railroad track, did, on the 1st day of August, 1857, negligently and carelessly run over and kill a cow of the plaintiff; and also, on the 15th day of May, 1858, an ox; both alleged to be of the value of one hundred dollars.…
