MEMORANDUM OPINION

MARTIN V. B. BOSTETTER, Jr., Bankruptcy Judge.

The debtor, Philander P. Claxton, III, (“Claxton”) was adjudicated a bankrupt March 21, 1980 by this Court. Thereafter, Claxton filed a Motion to Vacate the Adjudication of Bankruptcy under Rule 924 of the Rules of Bankruptcy Procedure and Rule 60(b) of the Federal Rules of Civil Procedure. This Court, without vacating the adjudication of bankruptcy, granted Claxton a new hearing limited to the issue of whether the creditors who filed and joined in the Creditors’ Petition seeking Claxton’s involuntary bankruptcy met the…
