Plaintiff and defendant own plots of land, opposite to each other, and both fronting upon a strip of land which was an ancient highway known as the Bear Swamp road, about forty-one feet in width. This road was discontinued as a public road, when a new highway known as the White Plains road was legally laid out and physically opened, and in physical use, which was prior to June 1, 1911.
