Plaintiffs Otay Mesa Property, L.P., Rancho Vista Del Mar, and Otay International, LLC (collectively “Otay Mesa” or “Plaintiffs'”) own land that is located in San Diego County, California, near the border between the United States and Mexico. In 2012, the United States Fish and Wildlife Service (“the FWS”) promulgated a rule that designates 57 acres of Otay Mesa’s land as a “critical habit” for the endangered Riverside fairy shrimp.
