OPINION

HENRY, Justice.

This is an appeal from a judgment of the Law and Equity Court of Blount County denying appellant’s application for a permit to engage in the retail sale of beer.

The Blount County Beer Board declined to grant a permit for the sale of beer at an establishment known as Gateway Restaurant. Pursuant to that denial the applicant, Larry Ronald Lones, filed his petition for the writ of certiorari.
