Appeal by the plaintiff, Marguerite Gilbert, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the. clerk of the county of New York on the 14th day of December, 1909, upon the dismissal of the complaint by direction of the court at the close of plaintiff’s case on a trial at the New York Trial Term.

The complaint alleges: “ That heretofore and at the Borough of Manhattan, City of New York, on or about the 23rd day of January, 1907, the defendant for value made, executed and delivered to the plaintiff her certain written instrument, or promissory note, of which the following is a copy, ¿viz., CI, Isabella V.
