Appeal from District Court, Fourth-District; Hon. J. E. Booth, Judge. Action by Armes Holm against Warren E. Davis, in which the Spanish Fork Co-operative Institution intervened. Judgment for plaintiff. Intervener appeals.

Tbe respondent commenced this action against the defendant Davis to recover damages for trespasses that it is alleged said Davis by himself and1 “by his agents” had committed on respondent’s land, which is specifically described in the complaint. Davis answered, justifying the alleged trespasses. His answer is, however, not material to the real questions involved here, and therefore will not be referred to¡ hereafter.
