Upon a written information a warrant was issued against the defendant on September 26, 1934, The defendant appeared on Sunday, October 21, 1934, and after pleading not guilty, without any adjournment a trial was had, witnesses having been sworn for the People, and the defendant in his own behalf. He was thereupon adjudged guilty and sentenced to the “ Rensselaer County Jail or pay a fine of $25.00.”

Section 5 of the Judiciary Law provides that “ a court shall not be opened, or transact any business on Sunday except to receive a *731verdict or discharge a jury and for the receipt by a court of…
