OVERVIEW
Plaintiffs, Montana Power Company and Idaho Power Company, filed suit in the District of Montana against the Secretary of Energy, the Assistant Secretary of Energy for Resource Applications, and the Administrator of the Bonneville Power Administration (BPA). They request a declaration that the Secretary, through the Assistant Secretary, had no authority to approve BPA rate schedules on an interim basis; that they be allowed to receive power under the new “F — 7” schedule without the “penalties” added on an interim basis; and that the rate…
