This is an action of unlawful detainer in which judgment was rendered on June 16, 1923, and an appeal was taken on the 21st of the same month. The plaintiff-appellees moved for the dismissal of the appeal because the action is founded on the non-payment of the rent and the rent for the month of July had not been deposited in the court. The appellants opposed the motion and filed a certificate of the clerk of the district court showing’ that the deposit was made on July 5th.
