ORDER AND MEMORANDUM OF DECISION

BRODY, District Judge.

Defendant, Gershon Navon, filed a Motion for Summary Judgment requesting that the Court dismiss Plaintiffs remaining claims from this case. 1 Plaintiff, Frank Simon, II, .has a pending claim for defamation against Defendant and has filed a Motion to Amend his Complaint to add a claim for malicious prosecution.
