OPINION OF THE COURT
GREENBERG, Circuit Judge.
This case is before this court on appeal from an order of the district court granting summary judgment on all counts to the ap-pellees in this antitrust action brought against them by the Massachusetts School of Law at Andover, Inc. (“MSL”). The district court had jurisdiction under 28 U.S.C. §§ 1331 and 1337, and this Court has jurisdiction under 28 U.S.C. § 1291.
