This is an appeal from an order overruling separate pleas of privilege urged by appellants, John W. Smith, Sr., and John W. Smith, Jr.

Plaintiff, Marva Ann Jones, brought suit in the District Court of Orange County, Texas, against Tary Kelly Owens, James Tartt, John W. Smith, Sr., and John W. Smith, Jr., seeking damages for personal injuries alleged to have been sustained on January 20, 1962, when the vehicle in which she was a passenger and operated by Fred L. Mitchell, collided with a vehicle allegedly driven by John W. Smith, Jr., and owned by John W. Smith, Sr.…
