An action to recover on an order payable to the plaintiff and accepted by the defendant company.

On November 11, 1926, the defendant company contracted with Watson, Frye Company of Bath, Maine, for the manufacture of one four pocket grinder, so-called, for grinding pulpwood in the proc*165ess of manufacturing paper, under a written order containing specifications and numbered 82728.

Prior to the receipt of the order, the Watson, Frye Company had purchased of the plaintiff certain material suitable to be used in the manufacture of machines of this type. Without going into all the details of the…
