State v. Odom

District Court of Appeal of Florida

Decided December 31, 2009No. 1D09-5158, 1D09-5160PublishedCited by 2 opinions

1Per curiam

Citing in its notice of appeal to section 924.07, Florida Statutes (2009), as its jurisdictional authority for doing so, the state appeals the lower tribunal’s “Order on Motions to Dismiss” in two related criminal proceedings. Appellees move to dismiss the appeals for lack of jurisdiction, asserting that the order is not final and not ■within the class of nonfinal orders appeal-able by the state under the statute and corresponding rule of appellate procedure. We sua sponte consolidate the cases for disposition by this opinion, and dismiss the appeals for lack of jurisdiction.
