This is an action of tort to recover for injuries received by the plaintiff in falling down an elevator well in a build*574ing belonging to the defendant. At the close of the evidence a verdict was ordered for the defendant.* The case is here on report with a stipulation by the parties that if the ruling was right judgment is to be entered for the defendant, but if there was evidence for the jury judgment is to be entered for the plaintiff for $1,000.
