At issue in this case is whether the Superior Court lacks subject matter jurisdiction over the plaintiff’s tort and G. L. c. 93A claims because determination of those claims requires the resolution of a substantial question of patent law under the exclusive jurisdiction of the Federal courts and, if the *227Superior Court has jurisdiction, whether those claims are barred by the applicable statute of limitations.
