This cause is a consolidation of two suits for the partition of the same land. Both bills were filed the same day. In the first bill filed, appellees James A. Wallace et at. were complainants and appellee C. P. Chamberlain was defendant. Appellants were not parties to the bill in that case. Chamberlain was the complainant in the other bill, and, in addition to the parties complainant and defendant to the bill filed by Wallace, he made appellants defendants to the bill filed by him.
