In an action to enjoin the *429obstruction of an easement, the plaintiff appeals from a judgment of the Supreme Court, Suffolk County (Henry, J.), entered July 3, 2001, which, upon an order of the same court dated May 23, 2001, denying his motion for a preliminary injunction and, sua sponte, directing the dismissal of the complaint, dismissed the complaint.
Ordered that the judgment is reversed, on the law, with costs, the complaint is reinstated, the order is modified accordingly, and the matter is remitted to the Supreme Court, Suffolk County, for further proceedings consistent herewith.
