Appeal from a judgment of the Supreme •Court at Special Term, entered February 1, 1969 in Clinton County, which denied a writ of habeas corpus without a hearing. On October 24, 1966 appellant was found guilty of the crime of murder in the second degree in Supreme ■Court, New York County, after a jury trial, and was sentenced to a term of 20 years to life. On appeal, the judgment was unanimously affirmed by the Appellate Division. (People v. Negron, 29 A D 2d 917.)
