Mullen, J., at suppression hearing; Ruth Pickholz, J., at plea and sentencing), rendered October 23, 2012, convicting defendant of criminal possession of a controlled substance in the third degree, and sentencing him, as a second felony drug offender, to a term of two years, unanimously reversed, on the law and the facts, and the indictment dismissed.
