In August, 1886, James Taylor brought an action of trespass on the case in the Circuit Court of Ritchie county against the Baltimore & Ohio Railroad Company, to recover damages caused by the ovei’ffow of his premises during a freshet in Hughes river, which overflow was caused by a bridge over *41said river on the Parkersburg branch of the Baltimore & Ohio Railroad, as he alleged. The defendant demurred to the declaration, and its demurrer was overruled. It demurred to plaintiff’s evidence, and the demurrer was overruled.
