This case originally began in a Texas district court in Travis County, Texas. Goetz & Sons there sought a declaratory judgment against the Board of Regents of the State Teachers Colleges of Texas to determine its rights under a construction contract. 1 The trial court entered a judgment for the Board. The Austin Court of Civil Appeals reversed and rendered, but the Supreme Court of Texas subsequently reversed the appellate court and affirmed the judgment of the trial court.
