The parties are tenants in common of a lot of land, with the buildings thereon, situated in Eocldand; the complainant being seized in fee of four undivided fifths and the defendant of one undivided fifth.
In this bill in equity, the complainant seeks a partition of the property by a sale of the same and a division of the proceeds between the tenants in common in proportion to their respective ownerships ; and also for a contribution by the defendant of his proportional part of sums expended by her for necessary repairs and taxes.
