This appeal by defendant is from a judgment for want of a sufficient affidavit of defense in an action of assumpsit on promissory notes. The firm of R. D. Wood & Company of Philadelphia had been in business for many years and in 1911 was composed of three brothers, Walter Wood, Stuart Wood, and George Wood, the defendant. It was then engaged extensively in various enterprises in said city and elsewhere, and owned land and other property in several states.
