RIPPEY, District Judge.

This action was brought by plaintiff to recover damages for personal injuries alleged to have been sustained by her when she was thrown from a deck chair in which she was sitting while she was a passenger on the Steamship Fort Victoria, owned and operated by the defendants. The alleged accident happened on or about January 6, 1929. This case was tried before me in April, 1935.
