DAUGHERTY, District Judge.
This is an action on an Acreage and Dry Hole Contribution Agreement entered into between the plaintiff and the defendant on December 22, 1960, and specifically involves the dry hole contribution provisions of said agreement.
In connection with this agreement the plaintiff drilled a well in Kingfisher County, Oklahoma, known as the Wrob-bel-Geis No. 1, having commenced the well on or about March 3, 1961, within the prescribed time as extended, and the drilling operation having been completed on or about May 9, 1961.
