This case is here on error to the overruling of a demurrer to the petition of Aker Brothers, plaintiff below.

The case was tried on the pleadings in the court of common pleas, resulting in a judgment for the plaintiff. >

There is no bill of exceptions in the case, and the first question here for consideration is the demurrer of the Fourth & Central Trust Company, that the petition does not state a cause of action against it. To consider the question, it is necessary to set forth the petition, as follows:
