Derek Boleware was convicted by a jury of the offense of Burglary of a Habitation and acquitted of the offense of Unlawful Possession of a Firearm by a Felon. Tex. Pen. Code Ann. §§ 30.02 & 46.04 (Vernon 2003). Boleware pled true to two prior felony convictions for enhancement purposes, and was sentenced to a term of thirty-five (35) years in the Texas Department of Criminal Justice – Institutional Division.…
