MEMORANDUM AND ORDER

SAFFELS, District Judge.

This matter is before the court on a petition for habeas corpus filed pursuant to 28 U.S.C. § 2254. Petitioner is serving a sentence of life for first degree murder, fifteen years to life for aggravated burglary, and nine years to life for felony theft following his 1977 convictions in the Coffey County District Court. 1

Respondents have filed an Answer and Return (Doc. 8), and petitioner filed a traverse (Doc. 11). Having examined the record, the court enters the following findings and order.
