This suit was brought by the heirs at law of Martin Hoagland, deceased, to recover for the use and occupation of certain premises, against the occupying tenant, John Crum. To the first plea filed by defendant a demurrer was sustained, and, on leave given, defendant filed an amended or second special plea, in which it ivas averred the cause of action in the declaration mentioned was for the rent of certain premises, which are accurately described, and for no other cause whatever ; that such lands were leased by defendant from Louisa A.
