This proceeding is instituted by the petitioner pursuant to the provisions of article 78 of the Civil Practice Act. Petitioner seeks an order of this court directing petitioner’s reinstatement to the office of clerk of the Surrogate’s Court of Ontario County, from which said office he alleges that he was removed without cause and without a hearing upon due notice upon stated charges.
