*1446After shooting another individual during an altercation outside of a bar in the City of Cohoes, Albany County, defendant was charged with attempted murder in the second degree, assault in the first degree (two counts), criminal possession of a weapon in the second degree and criminal possession of a weapon in the third degree. During the trial, defendant pleaded guilty to attempted murder in the second degree with no promised sentence other than that County Court would not impose the maximum sentence (see Penal Law §§ 110.00, 125.25 [1]).
