Plaintiff (respondent) was injured when she stepped into a hole in the sidewalk and curbing as she started to step from the street to the sidewalk at 220] North Broadway, St. Louis. She recovered a verdict and judgment for $10,000.00. Defendant's motion for a new trial was overruled, and this appeal followed.

Plaintiff alleged that the sidewalk and curb were defective and unsafe; that defendant had permitted the curb and sidewalk to become unsafe, and had failed to inspect and correct, although it knew or should have known thereof in time to have remedied prior to plaintiff's injury.…
