This action was brought to recover damages based upon the dual theories of implied warranty and strict liability in tort. There were originally four plaintiffs. One of the plaintiffs, Galluccio, leased a Ford Econoline Van from the defendant, Hertz Corporation. The remaining three plaintiffs, Richard Cicere, Salvatore Barnetti and Carmelo Di Maria were passengers in the van and were members with Galludo of a rock and roll band.
