Appellees, George G. Brandenburg and Joseph I. Brandenburg, co-partners doing business as Brandenburg & Co., filed their bill in equity in the circuit court of Cook county against appellant, the Buda Company, a corporation, for discovery only of certain facts in aid of their suit at law on a written contract theretofore brought by them in the same court against it. Appellant filed a general and special demurrer to the bill, which was overruled by the court, and appellant was directed to make discovery as prayed by the bill.
