This appeal was prosecuted by appellants, M. D. Sumter et al., plaintiffs below, from the judgment of the 58th district court of Jefferson county, sustaining the plea in abatement filed by appellee, Humble Oil & Refining Company, defendant below, against their petition. The parties were the same, and. in the same capacity, as in cause No. 51236 on the docket of the 58th district court of Jefferson county, wherein judgment was rendered sustaining appellee’s general demurrer against appellants’ petition.
