The Secretary of the United States Department of Health and Human Services (“Secretary,” “HHS”) appeals the district court’s order granting summary judgment for the plaintiff-appellee, Loyola University of Chicago (“University”), on the issue of whether the Secretary improperly disallowed a portion of the University’s claim for reimbursement of clinical medical education costs under the Medicare statute.
