In an action, inter alia, to recover a real estate brokerage *553commission, the plaintiff appeals from an order of the Supreme Court, Dutchess County (Brands, J.), dated July 29, 2003, which, upon a decision of the same court dated July 1, 2003, among other things, denied the plaintiffs motion for summary judgment on the complaint and granted the defendants’ cross motion for summary judgment dismissing the complaint.
