— The action was commenced by attachment at the suit of the appellee, H. O. Porter, a resident of Clarke county, Alabama; against Samuel H. Kress, for cause that said Kress was a non-resident of the State of Alabama, the attachment being founded on a demand sounding in damages merely, the complaint claiming $1,950 damages for unlawfully causing the plaintiff to be arrested- and' imprisoned in the city of Mobile, on a charge of petit larceny, on the 18th December, 1900¿
