2Per curiam

This matter is before the court on the State’s “Cross Motion for Summary Affir-mance.” We affirm.

BACKGROUND

Houk was charged with thirty-four counts of theft and misusing public money while acting as the principal of Grantsville High School. He pled guilty to four counts (two for theft and two for misuse of public funds), all third degree felonies. In exchange, the remaining counts were dismissed.

Adult Probation and Parole recommended that Houk pay $9,591.96 in restitution and spend a month in jail, to be stayed upon successful completion of community service. At sentencing, the trial…
