THIS CAUSE comes before the Court on Defendant, Intel Corporation’s (“Intel[’s]”) Motion for- Judgment on the Pleadings Pursuant to Rule 12(c) (“Motion”) [ECF No. 28], filed on January 14, 2013. Plaintiff, Esys Latin America, Inc. (“Esys”), filed a Complaint [ECF No. 1] on June 18, 2012. In an Order dated August 28, 2012 (“August 28 Order”) [ECF No. 22], the Court dismissed Count One of the two-count, breach of contract Complaint.
