WESTERFIELD, Judge.

The plaintiff, Kirby Bordelon, brings this suit against the defendant, National Life & Accident Insurance Company, Inc., of Nashville, Tennessee, claiming $500 as the beneficiary of a policy of industrial life insurance issued to Lucille M. Bor-delon on June 28th, 1937. He alleges that the insured died on the 25th day of November, 1937, while the policy was in full force and effect, and that on November 29th, 1937, due proof of death was furnished by him to the defendant, but that payment was refused upon the ground that the written application for the insurance contained…
