This suit was instituted in justice’s court, precinct No. 1, of Uvalde county, by Smith Land Company, appellee, against H. C. Tevebaugh, to recover a commission of 2½ per cent on a sale of land, aggregating $6,8840, and resulted in a judgment there in favor of appellee for the sum of $171. An appeal was taken to the county court of Uval-de county, and there the case was dismissed. Erom the order of dismissal the ease was appealed to this court, and was here reversed and remanded for trial in the county court. 146 S. W. 647.
