Appeal ,by the defendants, Otto Katnpfe and others, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Kings on the 17th day of March, 1909, upon the decision of the court rendered after a trial at the Kings County Special Term.

Burr, J.:

The complaint in this action, while it alleges that the defendants represented to plaintiff’s assignor that the parcel of ground which was the subject-matter of the contract between them contained 264.65 acres, and that plaintiff relied upon said representations and had no other information on the subject except so far as she could judge from looking over the said land, also alleges that such representations were.made by the defendants in entire good faith, and in the-belief that there, was in fact in said parcel of land the entire number of acres mentioned.
