Appeal from the District Court of Edwards, Tried below before the Honorable James Cornell. Appeal from a conviction of a theft of sheep, Penalty, two years imprisonment in the penitentiary. The opinion states the case.

LATTIMORE, Judge.
Appellant was convicted in the District Court of Edwards County, of the theft of about 150 sheep, the property of one F. M. Faulkner, and his punishment fixed at two years confinement in the penitentiary. Only so much of the facts become material as may be necessary to make clear the issues herein presented. The statement of facts is quite lengthy, much of the evidence being impeaching in character.
Appellant’s first contention is that the change of venue from Sutton to Edwards County, was made under such circumstances as that the latter county acquired no jurisdiction. As…
