I. BACKGROUND

From November 5, 2009 to November 8, 2009, Filbert Kinlichee (“Mr. Kinlichee”) went several times to the Emergency Department (“ED”) at Chinle Comprehensive Health Care Facility (“CCHCF”).1 (Doc. 1 at 1, 3-5).
